Florida Child Support: Legislative History

This bill amends child support guidelines to require re-computation of the support award where a change in income would change the award more than 15%, to require imputation of income even where the unemployment or underemployment is not voluntary, and to add that the court may take into account the parenting plan recognized by the parties, even if it is not reduced to writing, in awarding child support outside the statutory schedule.

This bill made several important changes to child support. Significantly, this bill:
-Changed the standard for determining the amount of child support award in cases where parents have a high income
-Created a rebuttable presumption that a person can earn minimum wage, and provides additional criteria for the establishment of an imputed income amount
-Amended the child support formula to account for income tax consequences of children and their financial support
-Reduces the 40% time-sharing threshold for a child support award adjustment based on time-sharing to 20%

This bill, among various other things, amended provisions of law dealing with child support. Specifically, the bill: Requires that after October 1, 2010, all child support and income deduction orders must provide for termination of support upon a child's 18th birthday, unless certain exceptions apply, and for a schedule stating the amount of support that will be owed for the remaining children, if any.

The bill makes numerous changes to the Child Support Program, which is administered by the Department of Revenue (DOR), Florida’s Title IV-D agency.
