HOW TO DETERMINE IF A CLIENT HAS TESTAMENTARY CAPACITY

"Under the law of most states, the creation of a valid will requires that the testator possess an intelligent understanding of (1) the act of making a will, (2) the nature and extent of his property, (3) the disposition he wishes to make of his estate, and (4) the natural objects of his bounty. If any of these elements is missing at the time the will is executed, the testator lacks testamentary capacity and the will is invalid."
