Florida Premises Liability concerns the area within tort and property law, which imposes duties depending on the classification of the person who finds themselves injured on the property. This LibGuide was created to give an overview of Premises Liability, relevant case law, as well as resources to help better understand premises liability.

My name is Hailey Hester and I am a student at Ave Maria School of Law. For this LibGuide, I chose the topic of Florida Premises Liability. Through my research of this topic, I have found excellent resources that I hope can help other law students or new attorneys in their navigation of understanding this legal issue. I have found great interest in this area of law and enjoyed my time researching while developing this Guide. 

What is Premises Liability?

Black's Law Dictionary premises liability is defined as "A landowner's or landholder's tort liability for conditions or activities on the premises."  

Individuals who enter onto the properties are classified into one of four categories:

1. Invitee

2. Licensee

3. Trespasser

4. Known Trespasser

The duty the property/business owner owes to each individual will vary depending on which category they fall into. This guide will take you step by step in determining how to classify the individual on the property and how to litigate the claim. 

Florida has developed specific rules and statutes related to premises liability.
