Complete Each Step to Gain Immigration Relief

  1. Apply for Continued Presence. Lasts for one year from date of issue. Provides work authorization and access to other benefits.
  2. Apply for T Visa or U Visa. Lasts for 3-4 years and may be renewable.
  3. Apply for Adjustment of Status to become a Permanent Resident.
  4. Become a Naturalized Citizen of the United States.   

Common Pitfalls

The following are mistakes that may harm an applicants eligibility for Immigration Relief.

  • Do NOT leave the United States prior to obtaining a Green Card- this may jeopardize your visa.

  • Always provide USCIS with your current contact information and notify then if you move.

  • Any participation in criminal activity may jeopardize your visa and may put you into removal proceedings.

Adjustment of Status - Green Card

Adjustment of Status Checklist

Below are the filing requirements as found on Form I-485, Supplement E. Explanation and further information for these requirements may also be found there.

Items needed for a T-visa holder to file for an adjustment of status:

  1. Form G-28

  2. Form I-484

  3. Form G-325

  4. Filing fee ($985) and Biometrics fee ($85). May provide a waiver request instead.

  5. Copies of all pages of the client’s passport.

  6. Copy of original I-94 arrival/departure record.

  7. Medical Exam.

  8. Evidence of continued presence.

  9. Evidence of Cooperation or Extreme Hardship.

  10. Evidence of Good Moral Character.

  11. Evidence relating to Discretion.

  12. If needed, Form I-601 with filing fee or waiver request. This is for seeking a waiver for grounds of inadmissibility.
