Florida Consumer Collection Practices Act by Mark Rasmuson: 2. Administrative Law

Administrative Remedies

Consumer Complaint

The Office of Financial Regulation (OFR) of the Financial Services Commission receives complaints from consumers regarding:

  1. Unlicensed or fraudulent activity of Florida's financial service providers; and
  2. Fraud, unfair practice, or wrong-doing by a "consumer collection agency" (see Fla. Stat. 559.55(7)).

See Fla. Stat. 559.725 for the law regarding consumer complaints and the pertinent administrative duties of the OFR.

Obtaining Legal Counsel

To recover money or property for fraud, unfair practice, or wrong-doing by a person as provided by the FCCPA, the OFR suggests "consulting legal counsel prior to or concurrent with our review" (see page 1 of the complaint form).
