WHERE & WHY

      Since a number of the key provisions, especially those requiring actions for compliance, are not in force yet, there is a lack of case law, and further a lack of analysis of, or substantial number of, judicial opinions. (see "Cases" tab for more information, including additional information for researching U.S. Tax Court [court of original jurisdiction] cases)

      However, with all that the health care overhaul entails and the vast confusion over its implementation, there is substantial information available from secondary sources. As legal practitioners will be called upon to respond to and (hopefully) resolve issues, a fortunate result is that educational materials are being produced at a significant pace.
