Florida Living Trusts by Bryce Davis: Forms

Forms

All of the forms on this page are from the following two sources:

  • West's Florida Practice Series, Elder Law
  • Florida Jurisprudence Forms, Legal & Business

I have chosen these sources because they are reputable, proven, and well-known. More importantly, most law libraries will have at least one of these sources in print. The majority of the forms may be found in Chapter 10 of the Florida Practice Series and in Chapter 34 of the Florida Juris. volumes.

Breakdown

Forms are templates available from various legal publications. They provide an excellent starting point for a lawyer drafting a will or other document. They are also useful for the layman to examine to determine the extent and depth required of a legal document.

As with any other resource, be aware of the form's source. A form from a reputable legal form book or online database is likely of far higher quality than a free one from a random internet site. That is not to say that a free resource can never be valuable; simply be skeptical and careful of documents of dubious origin.

Forms are abused perhaps more than any other resource. NEVER make the assumption that by merely "filling in the blanks" that a form will be adequate for your purposes. There are many factors and considerations in creating legal instruments that a layman will be unaware of; failing to address every contingency could have CATASTROPHIC consequences for your estate plan.

ALWAYS consult a licensed attorney prior to using any forms.
