The Probable Cause Standard

Probable Cause Standard

State v. Gonzalez

Defendant moved to suppress evidence discovered after stop of vehicle in which he was passenger. The Circuit Court, Dade County, Richard V. Margolius, J., granted motion, and state appealed. The District Court of Appeal, Cope, J., held that police officers had reasonable suspicion to support investigatory stop.

State v. Gonzalez, 682 So. 2d 1168 (Fla. 3d DCA 1996)

Reasonable suspicion is less demanding standard than that for probable cause, and considerably less than proof of wrongdoing by preponderance of evidence
