Modern Gaming Law: Sports Wagering Research Guide

Matthew D. Luciani

Introduction to Secondary Sources

The following page, through law review articles, statistics in state databases, and other secondary sources, will explore the different ways sports wagering law affects aspects of public policy. For example, the law review articles show how the perception of the Professional and Amateur Sports Protection act changed from an admired law which protected public policies at its inception in 1992 to a nuisance in the way of generating more state revenue after the Great Recession of 2008. Further, the included databases provides readers with detailed statistics of how much revenue the three largest sports wagering states derive from sports wagers and the treatises show portions of books that illustrate some of the public policy limitations that are still in place, such as basic aspects of professional athlete contracts, which include provisions ensuring they will not participate in sports wagering to preserve the integrity of the game.

Law Review Articles Analyzing the Professional and Amateur Sports Protection Act (PASPA)

The following section contains Law Review articles that analyze the Professional and Amateur Sports Protection Act (PASPA). The section is chronological from past to present in an attempt to help show how opinions toward the Act changed over time. The first of which, written by Former Senator Bill Bradley, illustrates a view supporting the Act. However, the following articles illustrate a different tone and analyze the benefits that could come from repealing the Act.

Databases

The following section contains the pertinent Titles or Chapters of Delaware, New Jersey, and Nevada's state codes which established the respective administrative structures that oversee all gaming revenue, licenses, and crimes in their respective states. Further, this section provides data from the New Jersey Division of Gaming Enforcement, Delaware Office of Lottery, and Nevada Gaming Commission on respective state revenue derived from sports wagering.
